Conditionally Exempt Small Businesses
To qualify as a conditionally exempt small business, an organization must generate no more than:
- 220 pounds of RCRA hazardous waste in any month, including every type of hazardous waste except used oil and cathode ray tubes
- 2.2 pounds of acutely hazardous waste in any calendar month
- 5 cathode ray tubes (CRT devices) in a calendar year
All businesses should have a mercury lamp management plan to ensure that they are in compliance with the State’s universal waste regulations.
The Department of Toxic Substances Control (DTSC) recommends that businesses:
- Develop a formal written mercury lamp management plan
- Train employees on the proper management of waste mercury lamps
- Follow the plan for day-to-day lamp management
- Periodically revise the plan when it fails or when simpler or more cost effective alternatives become available
