Question 4: Is the waste listed in Appendix X?

We now ask the fourth question in our quest to determine whether a waste is a hazardous waste: Is it listed in Appendix X (Chapter 11 of the CCR)? Appendix X contains a list of 791 chemicals and 66 common names of wastes. If a waste is listed or contains a listed chemical in Appendix X, it is presumed to be a hazardous waste.

However, the hazardous waste presumption can be removed and the presumed hazardous waste can be classified as a non-hazardous using analytical testing or knowledge of how the waste was generated and comparing that information with the characteristics of a hazardous waste.
