Persistent and Bioaccumulative Toxic Substances

Toxic List swf

Organic and inorganic chemicals listed below are tested for both Waste Extraction Test (WET) solubility and total concentrations. If the results of the soluble threshold limit concentrations (STLC) or total threshold limit concentrations (TTLC) equal or exceed their respective thresholds, the waste is a toxic hazardous waste.

a STLC and TTLC values are calculated on the concentrations of the elements, not the compounds.
b In the case of asbestos and elemental metals, the specified concentration limits apply only if the substances are in a friable, powdered or finely divided state. Asbestos includes chrysotile, amosite, crocidolite, tremolite, anthophyllite, and actinolite.
c Excluding barium sulfate.
d If the soluble chromium, as determined by the TCLP set forth in Appendix I of Chapter 18 of this division, is less than 5 mg/l, and the soluble chromium, as determined by the procedures set forth in Appendix II of Chapter 11, equals or exceeds 560 mg/l and the waste is not otherwise identified as a RCRA hazardous waste pursuant to §66261.100, then the waste is a non‑RCRA hazardous waste.
e Excluding molybdenum disulfide.

Activity 5c: Persistent and Bioaccumulative

Activity 5c
During the 1991 effort to incorporate the federal regulations into CA regulations, the Department appeared to change the STLC for Chromium III from 560 mg/l to 5 mg/l. This footnote was added to explain that in most cases it has not changed. The statement of reasons explained that the federal hazardous waste level for soluble chromium, trivalent or hexavalent, is 5 mg/l. California has a WET-soluble level for trivalent chromium (560 mg/l) and hexavalent chromium (5 mg/l). To use the non-RCRA 560 mg/l regulatory threshold, it must demonstrated first that the waste is not a RCRA waste.
