Wastes that have been shown through experience or testing to pose a hazard to human health or environment are considered toxic. This criterion permits a waste to be classified as hazardous due to carcinogenicity, acute toxicity, chronic toxicity, bioaccumulative properties, or persistence in the environment.

The DTSC is required to modify CCR Chapter 11 if a waste is identified as hazardous using this criterion and has statewide application. In the past, DTSC has identified specific waste streams containing crystalline silica and selenium below its RTs as a hazardous waste using this criterion; however, they were case-specific situations.
