Wastes mixed with or derived from other wastes that exhibit hazardous characteristics may be considered hazardous wastes

Unlike the RCRA listed mixture rule, wastes mixed with either a RCRA or a non-RCRA characteristic hazardous waste are hazardous wastes only if the resulting mixture still exhibits a hazardous characteristic. However, intentionally mixing to avoid regulation is considered “treatment” and requires authorization. Dilution is not the solution to avoid regulation, nor is it the solution to pollution. Dilution is considered treatment and requires authorization from DTSC. |
